Freight Protection — Terms & Conditions

These Freight Protection Terms & Conditions (“Terms”) apply to the optional Freight Protection service offered by Fifth Ridge PTY LTD (“we”, “us”, or “our”). By purchasing Freight Protection for your order, you agree to these Terms.

1. What Freight Protection Covers

Freight Protection is an optional, limited transit protection service that covers the insured order against loss or physical damage to the goods that occurs while the goods are in the custody of the carrier for delivery to the delivery address specified on the order. If a valid claim is accepted under these Terms, we will, at our discretion, either:

  • Replace the missing or damaged item(s)

Freight Protection is limited to the value of the goods actually paid for on the order and does not create an insurance policy beyond this limited obligation.

2. Exclusions — What Freight Protection Does NOT Cover

Freight Protection does not cover any loss, damage or claim resulting from or relating to any of the following (this list is illustrative and not exhaustive):

a. Theft or loss after delivery — any theft, disappearance, loss or damage occurring after the carrier has delivered the goods to the delivery location (including porch, driveway, garage, apartment common area, or any location where goods are left unattended) is excluded.

b. Damage during installation, assembly, modification or use — rips, tears, punctures, scrapes, or other damage that occurs while the customer or a third party installs, assembles, fits, alters or otherwise handles the goods after delivery.

c. Normal wear and tear or cosmetic deterioration from ordinary use, cleaning, sunlight, chemical exposure, humidity, rust, fading, or other environmental conditions.

d. Manufacturing defects and warranty claims — defects arising from materials or workmanship that are covered by the manufacturer’s warranty are excluded from Freight Protection. Customers should pursue manufacturer warranty or product guarantee claims directly with the manufacturer or via our standard returns/warranty processes.

e. Pre-existing damage — damage or defects that are visible or reasonably apparent on receipt if not reported in accordance with these Terms.

f. Improper packing, handling or storage by the customer after delivery.

g. Loss or damage caused by third parties (other than the carrier while in transit), including but not limited to vandalism, burglary, theft after delivery, deliberate damage by third parties, or actions of the customer’s household members, guests, contractors or installers.

h. Consequential loss — any indirect, special, incidental or consequential losses such as loss of business, loss of income, loss of enjoyment, or any costs other than the direct value of the goods.

i. Intentional acts or negligence of the customer, including but not limited to failure to follow product instructions, misuse, or abusive handling.

j. Customs, import duties, taxes or regulatory seizures.

k. Items not declared for Freight Protection or items for which Freight Protection was not purchased at the time of checkout.

l. Perishable goods, consumables, or goods with a limited shelf-life (unless explicitly stated).

m. Loss or damage resulting from inaccurate delivery information provided by the customer (e.g., incorrect address, incorrect recipient name).

3. Eligibility and Limits

  • Freight Protection must be purchased at the time of checkout for the order it is intended to protect. Freight Protection purchased after shipment or for previously shipped orders will not be accepted.
  • Coverage is limited to the purchase price paid for the covered goods on the order (exclusive of any taxes, duties, fees, and in most cases limited to the item price and any paid shipping for those items), up to the maximum amount shown at checkout.
  • Freight Protection does not extend to any amounts recoverable from the carrier through carrier liability or from any third-party insurer; we may, where appropriate, pursue recovery from carriers or third parties and will credit any amounts recovered against amounts paid to the customer under a Freight Protection claim.

4. How to Lodge a Claim

To make a claim under Freight Protection you must:

1. Notify us within 24hrs of delivery  (for damaged goods) or within 7 calendar days of the expected delivery date (for non-delivery). Claims made after this period may be denied.

2. Provide your order number, contact details, and a description of the issue.

3. Provide clear photographic evidence of the damaged item(s), including:

  • images of the damaged goods,
  • images of the packaging (outer carton and inner packaging) showing damage (if available),
  • images showing any visible markings on the parcel and the courier’s tracking details.

4. For non-delivery claims, provide the tracking number and any other relevant courier information.

5. Cooperate with any reasonable requests from us or the carrier for further information or inspection of the goods.

6. We reserve the right to require the return or disposal of damaged goods for inspection, or to request that goods be retained and made available for inspection by an appointed assessor or the carrier.

5. Assessment, Resolution and Timing

1. We will acknowledge receipt of a properly submitted claim within a reasonable time and will endeavour to assess and resolve claims promptly.

2. Where a claim is accepted, we will either replace the affected goods (subject to availability) or issue a refund for the accepted claim amount. The remedy is at our discretion.

3. If replacement goods are not available, we may provide a refund for the item value only.

4. Any refunds will be processed to the original method of payment and may take additional time to appear depending on the issuer.

6. Interaction with Carrier Liability, Third-Party Insurance & Consumer Rights

1. Freight Protection is a separate, optional service provided by us and is not a representation that the carrier does not have its own liability or insurance. Customers may have additional rights against the carrier or under other insurance policies (for example, homeowner’s insurance or third-party shipment insurance).

2. Freight Protection does not replace or limit your statutory consumer rights under applicable consumer protection laws, including rights for consumers regarding faulty goods, non-conforming goods or supply of services not provided with reasonable care and skill. Those rights remain available where applicable.

7. Refunds for Freight Protection Fee

1. The Freight Protection fee (e.g., $3.95) is payable at checkout and is non-refundable once the goods have been dispatched.

2. If an order is cancelled prior to dispatch and you requested a cancellation of Freight Protection, we will refund the Freight Protection fee in full.

8. Fraud and Misrepresentation

We reserve the right to deny claims, request additional evidence, and pursue legal remedies if we suspect fraud, misrepresentation or abuse of Freight Protection. Submitting false, forged or misleading documentation will result in claim denial and may lead to civil or criminal prosecution.

9. Limitation of Liability

1. Except where prohibited by law, our liability for claims under Freight Protection is limited to the remedies expressly set out in these Terms (replacement or refund of the item value). We are not liable for indirect, incidental, special or consequential losses, or for any loss or damage excluded in section 2 above.

2. Nothing in these Terms limits liability that cannot be excluded by law (for example, certain statutory consumer guarantees).

11. Miscellaneous

1. These Terms are governed by the laws of the state or territory in which Fifth Ridge PTY LTD is registered (or insert the specific state if you prefer). Any disputes arising out of these Terms will be subject to the non-exclusive jurisdiction of the courts of that state or territory.

2. If any provision of these Terms is held invalid, illegal or unenforceable, that provision will be severed and the remainder of the Terms will continue in full force and effect.

3. Failure by us to exercise or enforce any right under these Terms does not constitute a waiver of that right.

10. Changes to Terms and Termination

We may modify or discontinue the Freight Protection service or these Terms at any time. Changes will be effective from the date they are posted on our website. Changes will not apply retroactively to claims for orders placed prior to the change, except as required by law.
